"By way of explanation, the reason for this is that the behaviour complained of does not amount to a criminal offence. In order to prove a public order offence it must be shown that threatening, abusive or disorderly words were used. Words or behaviour that are "insulting" do not constitute a criminal offence....Whilst I accept that this incident must have been annoying for you and that the phrase used in this case clearly carries certain connotations, the single use of it does not render it criminal. I have also considered whether a racially aggravated offence is made out. I do not find that the phrase is racially or religiously aggravated. The legal definition for such offences provides that there should be a demonstration of hostility towards the victim of the offence based on their membership or presumed membership of a racial or religious group. In this case the comment was not based on such membership and therefore this is not made out in law."
[I don't want this post to be about me but compare and contrast this with the West Midlands Police (WMP) and CPS attitude when they took me all the way to trial for the single use of the word "c*cksucker". But then that was a vindictive political decision rather than a legal one in an attempt to shut this blog down.....]
It seems that despite their alleged keenness to prosecute Cllr Bob Piper for use of this term WMP actually also support this view and one has to question whether the moral "Cowards in Blue" deliberately f*cked up Piper's case to ensure that one of their mates "got off" (see further below). I wrote this to WMP but they have failed to respond and so we must assume that they share the CPS view of the words used which, I submit, certainly fit the definition of "disorderly":
"The CPS have written to The Skidder stating that shouting "Seig Heil" at someone in a public place eg a pub, is perfectly acceptable - certainly in single usage.
I now intend to enlighten the good folk of Sandwell of their freedom to use this term if they so wish. Do WMP wish to make any observations that I can print please?
The CPS say the expression "Seig Heil" as a form of abuse is NOT racially or religiously aggravating as it is not based on the membership of a racial or religious group. It simply has "certain connotations". I am sure that will come as some surprise to members of our community who are Jewish and I would again invite WMP to comment on that please."
All this comes, of course, from the behaviour of potty-mouthed Labour Cllr Bob Piper, the Chair of the Licensing Committee "lol", and his outburst in an Oldbury public house last July. The full story can now be told. Shortly before this incident I was called for interview because of the use of the word "c*cksucker" in a private conversation which was overheard. The head of Sandwell Council's bent paid-service, Jan Britton, put his pals in blue under pressure to prosecute me and they duly obliged for their friend. I wrote this to ALL Labour Councillors on 15th June, 2018:
"Eid Mubarak to those celebrating.
Over the years I have known most of you, I have been insulted and abused on occasions too numerous to mention. The "F" word has been used liberally and sometimes the "C" word. I have had councillors literally screaming abuse in my face. I have been threatened with physical violence. On an infamous occasion one or more councillors stole two eggs from SMBC and threw them at myself and other peaceful protesters.
It seems that hitherto I have had a thicker skin than your Chief Executive [sic] and that the alleged use of a single swear word is now classed as a criminal offence! I hereby put you on notice that I am no longer going to tolerate this sort of abuse. I have rights too. Please be aware that from today all abuse and threats WILL be reported to West Midlands Police forthwith. You have been warned and I shall produce this notice to WMP on each and every occasion it is required."
It was probably inevitable that the first Councillor to transgress was Piper and he did so just a month later after the July Council meeting. It should be remembered that Piper's mouth has got him into trouble of numerous occasions in the past eg:

I should also add here that, from time to time, the pathetic "Labour Group" and assorted party members have tried to smear me as a supporter of the "far right". I am not of that persuasion but the allegation is based solely of the work I do with Darryl Magher in attempting to expose corruption in Sadders. Nevertheless I have written evidence of sundry "Labour" people spreading this b*llocks including Cllr John "Jedward" Edwards and the ever-popular Derbyshire resident Pam Pulsford (aka Mrs "Squealing" Eling).
As ever Darryl and I tried to speak to the sheep as they did the perp walk (aka "the Walk of Shame") into Oldbury Council House and then repaired to Wetherspoons opposite. We were just leaving when Piper came in with Ann Jaron. I was leading the way and Darryl was behind me and to my left. As Piper went past I heard him say "Sieg Heil". I did not see it but he also made a Nazi-type salute to Darryl. I asked him if he was talking to me and he told me to "piss off". I asked the question again and he said "go on, piss of out of here". We both tried to get Piper to repeat what he said whilst filming him. We both made complaints to WMP and they secured the video footage from the pub. Although no sound was available on the footage it clearly showed that both myself and Darryl were very aggravated by something Piper had said.
Readers of this blog will know that corrupt WMP work hand in glove with Sandwell Council. One senior SMBC officer who left in disgrace was shagging an inspector. A Sandwell Inspector enjoyed "golf and spa days" with "colleagues" at the Council. The Blues have pulled various investigations eg Lucy Cashmore, multiple false register of interest entries (criminal offences), Cooper's trolling campaign and, worst of all, major fraud where the Regional Fraud Team started to make progress and were then pulled off the case. On the other hand, they have opened 8 (yes, eight) enquiries into this blog!!!!
The CCTV put the bent cops in a quandary since there was clear evidence, even without sound, of Piper provoking an incident in a public house. The police tell me - wait for it - that they sent at least one officer round to Piper's house to beg him to apologise! (Again, compare and contrast the treatment meted out to me in the "c*cksucker case" where they rushed straight to charging me without even a proper, full, interview!)
Piper was also offered a caution but did not accept it. Thus he was charged - and with an allegation that he had committed a racially-aggravated offence. Now I am not sure what Darryl said in his interview but this was put to me in mine and I specifically stated that I did NOT view it as a racially-aggravated matter. I said that in my mind it was a straightforward public order matter (which would give the police six months to bring a charge).
The police charged Piper and told me explicitly that they wanted to take the matter to Court as Piper would not accept a caution (and Sandwell coppers never lie). Although the incident happened on 17th July, 2018 and WMP secured the CCTV the next day they did not submit a file to the CPS until 7th October (presumably as they had been trying to cut a deal with the arrogant Piper). The CPS say in writing that on 18th October a conditional caution for a public order offence was appropriate (and it seems from WMP that Piper has never denied making the insulting remarks). (Once again compare this with my treatment in the c*cksucker matter where the CPS made it plain to me and my solicitors that they were determined to take me all the way to trial.) The CPS say the police then tried to administer a caution for a racially aggravated offence which was not what the CPS had authorised (was this done deliberately in the knowledge that a charge of that nature would never stick and Piper was unlikely to be found guilty?)
Piper - quite rightly in my view - would not accept the "racially-aggravated" caution and so "without the authority of the CPS" the police charged him with the much more serious offence. The matter was due for a "first time up" hearing on 16th January, 2019 but the CPS withdrew the charge. They were still - just - inside the six months and could have still got the police to administer a public order caution or charged him with the lesser offence. As it happens the CPS apparently did not communicate with WMP at all. Piper's personal friend and hard-left ally, "journalist" George Makin, then splashed false stories in the local press that Piper HAD been cautioned and all charges were now dropped.
When I contacted Ch Supt Richard Baker (or "Rich" as he is known to his pal "Squealing" Eling) to say that it was disgusting that the victims had not been told that the charges had been dropped and had to read it in the press, he was genuinely surprised at what I was saying and promised to check it out - which, to be fair, he did. This led to the police themselves appealing the CPS decision and, as shown above, they decided that hurling "Sieg Heil" at someone in a pub is just "insulting" and not a crime. (The two "piss-offs" were totally ignored - surely it is arguable that two "piss-offs" equal one "c*cksucker" in the weird collective mind of Sandwell Police? And just because Piper is the Chair of the Licensing Committee he has no power to tell anyone to piss off out of a pub!)
George Makin was quick to get further stories in the craven local mainstream media - and blithely admitted that his earlier story which said his mate had received a caution was "a mistake"!!!! (Makin, despite his pro-left wing views, is funded by the supposedly impartial BBC as a "local government democracy reporter "lol").
By now the six month period to bring a lesser charge had expired even if the CPS had wanted to. Piper "got off" scot free without even a caution. The police say that Piper had made the insulting comments but claimed to have done so at Darryl and not me and that this was a "joke" (though he later stated via Makin that he was only "half-joking" which means that he was half-serious!) The Police told be that arrogant Piper was "sorry" for what he had said but he has shown no remorse whatsoever to either complainant and, despite the written warning I had sent to him (see above), he has written to me saying that my complaint was "vindictive". Same old nasty piece of work Bob and, as ever, a Labour Councillor playing "the victim".
In his capacity as Chair of the Licensing Committee Piper has to decide in a judicial fashion whether pubs that "misbehave" and run a rowdy establishment should face sanctions - including loss of their licence. Even though he evaded criminal charges the fact remains that he used insulting words in a pub with the intention of provoking a reaction. He has returned to chairing the licensing committee and here he is after a sub-committee meeting where he had just adjudicated on a violent incident at a pub. I asked him whether he was a fit and proper person to chair the Licensing Committee - clearly he is not and should be removed from this position (not least because his retention of this position throws SMBC open to legal challenge should a licensee object to one of his rulings). This is unlikely to happen, however, under the "weak as piss" leadership [sic] of new Labour supremo Steve "Luvvie" Trow.
Incidentally, at the hearing referred to above the Sandwell Police officer attending said that they held confidential "criminal intelligence" relating to gangs operating in Tipton. Piper asked if he could see it. The officer said the data was in raw form (ie nothing redacted) but still handed it over to Piper! Thus someone the police claim they were desperate to charge a couple of months ago is handed top secret criminal intelligence - just like that! (I don't think Piper is corrupt in the sense that some of his comrades have been - although he has actively and willingly supported many highly dubious Labour decisions over the years - but it is clear that there are still corrupt Labour elected members of the Council and Jan Britton's paid service is riddled with corrupt employees who have facilitated all that has gone on. In the premises is it appropriate for Sandwell Police to hand confidential criminal intelligence to ANYONE connected with this organisation? Piper has a big mouth - see post above - and so is it right to entrust HIM with such matters?)
Like his "socialist" pal, Steve "The Milkman" Eling, Piper might spout left-wing claptrap but he is inordinately fond of money and is very comfortably off. The good news folks is that rather than be sacked from his committee positions Trow is keeping him (and Squealing) in situ and so extra allowances roll in despite his appalling behaviour. Bob, next time I see you in the Spoons I think the beers should be on you!
*Of course, many in the Black Country know that they cannot rely on WMP for any sort of justice and resort to more physical methods of alternative dispute resolution. If you are planning to "do a Piper" just be careful you don't pick the wrong target and end up with a big dental bill "lol"! (And no, WMP that is NOT a threat by ME to anyone so no need to open yet another crime reference number).
